This website, whydoubleu.com, is operated by Crexels Inc., doing business as WhyDoubleU Photography (“WhyDoubleU”, “we”, “us”). By using the website or a private client gallery you agree to these terms. If you do not agree, please do not use them. Your use is also covered by our Privacy Policy.
1. About the website
The website shows our portfolio and lets our clients view and download their photographs. The information on it is general and may change. Nothing on the website is an offer that binds us until we confirm a booking in writing. The website links to other sites, such as Instagram, YouTube, Substack and Voyage LA. We do not control those sites and are not responsible for them.
2. Photographs and copyright
Unless we say otherwise, all photographs, text, logos and other content on this website are owned by Crexels Inc. or used with permission, and are protected by copyright. You may not copy, download, edit, republish, sell or use the portfolio photographs, or use them to train software, without our written permission.
3. Client galleries
- A gallery is private and meant only for the people we give access to. Your sign-in is personal. Keep your password to yourself, and tell us at once if you think someone else has used it.
- We may suspend or remove access if these terms are broken, to protect a client’s privacy, or to keep the site secure.
- We aim to keep galleries online for a reasonable time, but we do not promise to host them forever. Please download the photographs you want to keep, and keep your own copies.
4. Using the photographs you download
Unless your written agreement with us says something different, photographs you download from your gallery are licensed to you for personal, non-commercial use: for example prints, albums, your own walls, and sharing with family and friends, including on social media. Please credit WhyDoubleU Photography when you post them. Commercial use (advertising, marketing, selling, or publishing for a business) needs our written permission. Copyright in the photographs stays with us.
5. Sharing a gallery
Where we switch it on for a gallery, you can share it by entering another person’s name and email address. If you do:
- you confirm that you have a good reason to give us their email address, and that they would welcome an invitation;
- that person will be able to see, and download if downloads are allowed, every photograph in the gallery, including the people in them, so only share with people you trust;
- you can stop sharing at any time from the Share window, and we can remove access ourselves;
- there is a limit to how many people you can share a gallery with, and a person who received a gallery from you cannot pass it on.
6. Photographs of people
We do not use photographs from a private client gallery in our portfolio or marketing without the permission of the people who appear in them.
7. Invoices and payments
WhyDoubleU Photography is a division of Crexels Inc.. All invoices for our photography services, and for any prints or other products, are issued by Crexels Inc., and all payments are made to Crexels Inc.. The price, deposit, cancellation and delivery terms for your booking are set out in your written quote, estimate or agreement, which applies together with these terms. If the two differ, the written agreement applies. This website does not take payments and we do not store card details on it. If we sell prints online, they are sold by Crexels Inc. and the shop will show its own delivery and returns terms at checkout.
8. Acceptable use
Please do not try to get into accounts or galleries that are not yours, guess passwords, probe or overload the website, copy it automatically, upload anything harmful, or use it for anything unlawful. We may block anyone who does.
9. No warranty and limits on liability
We take care with the website and the galleries, but we provide them “as is” and “as available”, and we do not promise that they will always work, be error-free, or keep your files safe. To the fullest extent the law allows, Crexels Inc. is not liable for indirect or consequential loss, or for loss of data, arising from your use of the website, and our total liability for any claim about the website or a gallery is limited to the amount you paid us for the related service. Nothing in these terms limits liability that the law does not allow us to limit.
10. Changes
We may update these terms. The version posted here, with its date, is the one that applies. If you keep using the website after a change, you accept the new terms.
11. Governing law
These terms are governed by the laws of the State of California, and any dispute about them will be heard in the state or federal courts located in Los Angeles County, California.
